Terms of service

1. Agreement

These terms are between you and Investors Equity Group, LLC (“IEG”, “we”, “us”). By using investorsequitygroup.com, our application at apply.investorsequitygroup.com, or by submitting an enquiry or application, you agree to them. If you do not agree, do not use the site.

If you are using the site on behalf of a company, you confirm you are authorised to accept these terms for it.

2. Nothing here is an offer to lend

Everything on this site — programme descriptions, rates, examples, and any answer our assistant gives you — is illustrative. It is not a commitment to lend, a quote you can rely on, or an approval.

A loan exists only when we issue written terms and those terms are accepted, and it funds only when every condition of the approval is met. Rates, terms, programmes and availability change, vary by state, property and transaction, and remain subject to credit, property, title and insurance approval.

3. Who we lend to

You are eligible to apply only if all of the following are true:

• The borrower is a business entity — a corporation, limited liability company, partnership or trust — and not an individual.
• The loan is for a business purpose.
• The property is residential investment property that no borrower, guarantor or their family occupies as a primary or secondary residence, and is held to rent or resell.
• The property is in one of the 16 states where we currently lend. See our lending footprint.

We do not make consumer loans. We do not lend on a property you live in or intend to live in, and we do not lend to individuals in their own name. If your circumstances change so that any of the above stops being true, tell us — continuing an application on a false basis is a material misrepresentation.

4. The information you give us

You agree that the information and documents you provide are true, complete and yours to provide, and that you will tell us promptly if something material changes before closing.

By applying, you authorise us and our service providers to verify what you tell us, and — separately and in writing — to obtain consumer credit reports on the individuals who guarantee the loan. Mortgage fraud is a federal crime.

5. Your account

Access to your file is by a code or link sent to the email address or mobile number you give us. Keep them to yourself; anyone holding them can see your file. Tell us at once if you think someone else has access. You are responsible for what is done through your access.

6. Fees, and what is refundable

Any fee is disclosed before you are asked to pay it. In general terms:

• An application fee covers the cost of underwriting your file and of the third-party reports we order on it.
• The part of that fee attributable to the appraisal stops being refundable when the appraisal is ordered, because at that moment the money is committed to the appraisal management company. You are told this before the order is placed.
• Fees for work already performed, and amounts already paid to third parties on your behalf, are not refundable if you withdraw or the loan does not close.

The specific fees, amounts and refund terms for your file are those disclosed to you on it, and they govern if they differ from this summary.

7. Electronic communications and signatures

You agree to receive communications from us electronically — by email, text message, and through your file — and that electronic records and signatures satisfy any requirement that a communication be in writing or signed. You can withdraw this consent by writing to us, though we may then be unable to continue with an application. Text messaging terms are in our privacy policy.

8. Acceptable use

You may not:

• submit information that is false, or that belongs to someone else without their authority;
• attempt to access a file, account or system that is not yours;
• probe, scan, overload or interfere with the site or its infrastructure;
• scrape or systematically extract content from the site;
• use the site for anything unlawful.

We may suspend or withdraw access to the site or to an application at any time, including for any of the above.

9. Our content

The site, its content, and the software behind it belong to IEG or our licensors. You may read and print pages for your own use in connection with a transaction with us. Everything else — copying, republishing, or using our name or marks — needs our written permission.

10. Third parties

The site links to and relies on services we do not control, including our credit vendor, appraisal management company, payment processor and messaging provider. We are not responsible for their content or their conduct, and their own terms apply to your use of them.

11. Disclaimers and limits

The site is provided “as is”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the site will be uninterrupted, timely, secure or error-free.

Nothing on this site is legal, tax, accounting, investment or financial advice. We are not your advisor. Get your own professional advice before entering a transaction.

To the fullest extent the law allows, IEG is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits or lost opportunity, arising from your use of this site — and our total liability arising out of the site is limited to the fees you have paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

You agree to indemnify IEG against claims arising from your breach of these terms or from information you provided that was untrue.

12. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or the site will be brought exclusively in the state or federal courts located in Lee County, Florida, and you consent to their jurisdiction.

The terms of a specific loan — including any different governing law, venue or dispute resolution provision — are those in the loan documents, and those govern that loan.

13. Changes

We may change these terms. The effective date at the top tells you when the current version took effect, and continuing to use the site after a change means you accept it.
